Abstract

This article deals with aspects related to the Ordinary Criminal Appeal nº1096, trial in the Supreme Court in the year 1970. The defendants were university students of the Faculty of Medical and Biological Sciences of the city of Botucatu, who rose during the dictatorial government, initially claiming money for better functioning of their courses, and later freedom to exercise his right to claim. Will be analyzed the view that the Ministers of Brazil 's highest court could see the student movement at the time of restriction of rights, the discourse of impartiality of judges and the need for maintaining the status quo in AI- 5 post .
